FBI Agent Arrested for Driving Under the Influence in a Government Vehicle

A Florida FBI agent was pulled over in a government car and arrested and charged for driving under the influence (DUI).

Now, forty nine years old, Jorge Miyar has been a part of the Florida FBI for twenty three years. Miyar was at a DUI checkpoint that was scheduled for him when he ran over a curb while trying to drive through the appointed cones. It was stated by the police that Miyar smelled strongly of alcohol and was clearly impaired.

Miyar failed the sobriety tests he was given and refused to participate in a breathalyzer test. Miyar told the police that he had just left a party and only had five beers. He made the point to let them know that he also ate while he was there so that maybe the food could soak up some of the alcohol. Miyar is very aware that he will have to face harsh penalties because of his position with the FBI.

It is definitely a bad sign that the charged FBI agent was driving his government vehicle while under the influence. DUI checkpoints are to help enforce the rule of not driving while intoxicated. There is not a law that states you have to give the officers any information, because as most people are aware you have the right to an attorney.

Your best bet is to consult with a Miami criminal attorney in the area to have them help you with the proceedings. They can also help the process go by much smoother for anyone that has been charged with this type of criminal act. Driving under the influence is against the law, and there is no tolerance for anyone who indulges in it. That is why it is important to have a Miami DUI lawyer that has the knowledge to aggressively fight your DUI charge.

Remember that just because someone may get arrested for driving under the influence does not mean that they will be convicted of the charge. The state must prove your blood alcohol content at the time you are driving, not several hours after. This is what proves whether or not you are over or under the legal limit. The legal limit is .08 in every state. To be on the safe side, it is best if nobody gets behind the wheel of a car that has even consumed one alcoholic beverage!
